Termes of Sale

 

1. Scope

   11. These Terms of Sale ("TS") apply to all sales of products on this Page and/or Website without regard to any conflicting, contrary or additional terms and conditions in any purchase or other communication by you. None of those conflicting, conflicting or additional terms and conditions shall be deemed accepted by us unless and until we expressly confirm our acceptance.

   12. We reserve the right to modify these Terms of Sale (TS) at any time. We will give you fifteen calendar days' notice of any changes by posting a notice on our online store page. Before using our online store, please read these Terms of Sale carefully. By purchasing one or more product·s, you agree to these Terms of Sale.

If you do not agree to these Terms of Sale, please do not purchase our products from our online store.

2. Item Returns and Confirmation

All orders delivered by us and including one or more product·s is/are open for acceptance within fifteen (15) calendar days from the date of delivery of the order in question, however a confirmation of acceptance expressly must be made by us prior to such return. Indeed, after fifteen (15) calendar days following delivery and/or by noticing the non-compliance with the conditions set out in article 21 below, we will not accept any return and no refund will be made.

21. Times Required to Contact Client Serivices

You must inspect the delivered goods as soon as they are received. The buyer, after checking the damage or inaccuracy of one or more product·s, has one hundred and twenty (120) hours to inform customer services of any such inconvenience. Upon knowledge of the situation, customer services will inform the buyer about the way forward for the return of the article·s in question.

3. Incomplete Order

We reserve the right to make the delivery in several instalments. Delivery of items in the clothing category can be delivered over two weeks if they have not been available in stock. The buyer who receives an order delivery with an/or item·s missed should wait a week to contact customer services. As soon as the problem is known, the sales departments will take the necessary action.

4. Delivery and Late Delivery

Normally, deliveries of products nationwide are made within seven (7) calendar days from the date of receipt of the order. For products that have not been in stock, delivery may take up to two weeks from the date of receipt of the order. For the delivery of products on an international scale, many factors can come into play, in fact, it can take several weeks or even months from the date of receipt of the order.

5. Prices and Payment

The prices of the products are those indicated or displayed at the bottom of the product in the online shop. All prices are exclusive of taxes, impositions, and other charges, including but not limited to sales, use, excise duties, value added taxes, and similar taxes or fees imposed by any governmental authority. In fact, mandatory taxes may be added to the price of the product in question and affect your balance.

Payment for an order must inevitably be made by credit or debit card to complete the product purchase process in our online store.

6. Guarantee

We warrant that upon delivery and for a period of twenty-four months that the goods purchased hereunder will conform in all material respects to the manufacturer's specifications for such goods and will be free from defects in workmanship, materials and design under normal use.

The warranty does not cover damage resulting from misuse, negligent handling, lack of reasonable maintenance and care, accident or abuse by anyone other than us.

7. Limitation of Liability

None of us shall have the right and none of us shall be liable for any indirect, special, consequential or punitive damages of any kind, including but not limited to business interruption costs, loss of profit, loss of data, etc.

Your recovery from us for any claim shall not exceed the purchase price of the goods giving rise to such claim, regardless of the nature of the claim, whether in contract, tort, warranty or otherwise.

71. Disclaimer

We will not be liable for any claims based on our compliance with your choices, specifications or instructions, alteration or alteration of any goods by parties other than us or used in combination with other goods.

8. Force Majeure

Either party shall be released from any delay or failure to perform or deliver if caused by any cause of event or contingency beyond its control, including, but not limited to, acts of God, acts of war, fire, insurrection, strikes or other serious labor disputes, riots, earthquakes, floods, explosions or other natural disasters.

The obligations and rights of the party so excused shall be extended from day to day for a period equal to the period of such excusable interruption. When such events have subsided, the obligations of the parties will resume. In the event that the interruption of obligations in such situations lasts for more than thirty calendar days, each party shall have the right to terminate the applicable sales contract·s, without liability, thirty calendar days before written notification to the other party.

9. Varying

91. The United Nations Convention on the International Sale of Goods does not apply to these Terms of Sale or any contract of sale entered into between us or accepted by you.

92. No waiver of any provision of these Terms of Sale shall constitute a waiver of any other provision or of the same provision of any other provision. The failure of either party to enforce any provision of these Terms of Sale shall not constitute a waiver of such provision or any other provision of these Terms of Sale.

93. If any provision of these Terms of Sale is found by a court of competent jurisdiction to be illegal, invalid or unenforceable, such provision may be modified by such court in accordance with the law giving effect to the intent of the parties and enforced as amended. All other terms and conditions of these Terms shall remain in full force and effect and shall be construed in accordance with the amended provision.

94. These resumes entered into between us shall be governed by and construed in accordance with the laws of the United States without giving effect to any choice of law or conflict of law provisions. Any suit, action or proceeding brought by either of us against the other shall be brought exclusively in the competent courts of the United States, however, without prejudice to our right to bring any suit, action or proceeding in any other court that would have jurisdiction if such provision had not been incorporated into these Terms of Sale.
